Fan Works, Copyright and Fair Use

No, it was a fair enough point on that. I agree that it isn't the only route that companies, like CBS, can take. My larger point being that corporations have avenues already under the law that allow them to allow for fan productions.

ETA: Stumbled upon an interesting article regarding scholastic helping young artists by getting them to sign over their IP rights.

Why is this an issue if the kids wouldn't profit from it? This gets right at the heart of this issue.

That Scholastic thing is some fucking bullshit.
 
Rights holders should have complete control of their product, and shouldn't be forced to allow other people to "play with their toys" if they don't want to. If they want to allow fan works, then that's cool, but they shouldn't be forced to just because a few people think they can tell a story with it.
I know if I had control over my own IP I would to be the one with final say over who gets to use it, and what they are going to do with it.
They thing to keep in mind is Copyright isn't just for big corporations, it's also for the small independent creators who are telling their own stories.
 
It's a license to steal just like the open submission policy was.

I wrote a story containing an Andorian holographic slave colony and Voyager later wrote 'Displaced'. Same deal - all derivative rights.
