How about this? It was the flagship while Pike was Captain (him already being one of the top 5 most decorated captains in the Fleet) and that title went with him to his next command as Fleet Captain. Thus Kirk doesn't command "the flagship" in TOS. ???...The "flagship" comment is gonna be like pulling the pin on a grenade but I can live with it. I'm way beyond the point where it's worth being anal about some of the continuity stuff; for me that ship sailed a long time ago...

I'm digging the SNW set design, it's giving me those 2009 vibes. A good update/reboot of TOS. Weird that M'Benga is CMO and a full commander but apparently gets demoted in favour of McCoy. Perhaps they'll retcon them to joint CMOs when McCoy inevitably arrives in season 3.
